Removed Items - Methylene Chloride Solvent and Strips-It Paint & Varnish Remover

In March of 2019 a final rule on methylene chloride by the Environmental Protection Agency prohibited the sale of methylene chloride to end users (consumers) for paint and coating removal.

On March 26th, 2021 we requested a review and determination from the EPA on our process for verifying business entities purchasing items containing methylene chloride. Our review & determination passed through multiple representatives of the EPA until getting a response on Sunday April 4th.

"Under the Rule, a “retailer” is defined in 40 C.F.R. 751.103 as “a person who distributes in commerce or makes available a chemical substance or mixture to consumer end users, including e-commerce internet sales or distribution. Any distributor with at least one consumer end user customer is considered a retailer. A person who distributes in commerce or makes available a chemical substance or mixture solely to commercial or industrial end users or solely to commercial or industrial businesses is not considered a retailer.”

Based upon the EPA’s review, Caseway appears to have a mix of both consumer and business customers and therefore fits within the “retailer” definition. Retailers are prohibited from the selling any methylene chloride, including any methylene chloride containing products, for paint and coating removal, regardless of whether the sales are exclusively to businesses. 40 C.F.R. 751.105(c). In order to comply with the Methylene Chloride Rule and sell methylene chloride for paint or coating removal, Caseway must make all its products available exclusively to commercial or industrial businesses."
